The APS has announced a new agreement for the authors

The editorial from the Physical Review A 78 040001

In its October 1 (2008) editorial, Gene D. Sprouce (APS Editor-in-Chief) stated that the APS had changed the copyright agreement for the authors. In the new agreement, "copyright rests with the author for derivative works that contain at least 10% new material and not more than 50% of their article that is published in an APS journal" [201-1]. The new agreement considers the reuse of a material from an article. The new copyright form is now available. More information is accessible online.
